What is the Purpose of this Privacy Policy?

This privacy policy ("Privacy Policy") describes how we collect and use your personal data in accordance with the Information Technology Act 2000 and the rules promulgated thereunder (the " IT Act") and the Digital Personal Data Protection Act, 2023 (the " Act"), and any other laws applicable to the processing of your personal data to which we are subject, in each case as amended or updated from time to time (collectively referred to herein as the "Data Protection Legislation").

Who are We?

We are eXp Global India Private Limited, a company incorporated under the Companies Act 2013 having its registered office at 48, Amarpali, I.P. Extension Patparganj, Delhi 110092 India (hereinafter referred to as "eXp India" or "Company"). eXp India's parent company is eXp World Holdings, Inc, a company incorporated in the state of Washington, United States ("eXp US"). In this Privacy Policy, references to "eXp", "we", "us", and "our" refer to eXp India and eXp US.

This Privacy Policy supplements the eXp World Holdings, Inc. privacy policy located at https://expworldholdings.com/privacy-policy/ and it is important that you read this Privacy Policy together with any other privacy policy for fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your personal data. This Privacy Policy supplements other such notices and is not intended to override them. Capitalized terms not defined herein shall have the same meaning as defined in the privacy policy located at https://expworldholdings.com/privacy-policy/.

eXp respects your privacy and is committed to protect your personal data. eXp is required under Data Protection Legislation to provide you the information contained in this Privacy Policy. Please read the following carefully to understand eXp's practices regarding the collection of your personal data:

when you visit or use Sites, including www.expglobalindia.co.in, whether you are opening and using an online user account or not, regardless of where you visit or use the Sites from; and/or
which we otherwise receive or collect from you in the course of the provision of our Services. It also describes certain privacy rights and data protection laws that may apply to you.

I. DEFINITION

"Affiliate" being a corporate entity, shall mean any entity or Person, which controls, is controlled by or is under the common control of such entity or person;
"Company" means a company incorporated under Companies Act 2013 or under any previous company law
"Data fiduciary" means any person who alone or in conjunction with others determines the purpose and means of processing of personal data;
"Data principal" means the individual to whom the personal data relates;
"Data processor" means any person, who processes personal data on behalf of a data fiduciary;
"Digital personal data" means personal data in digital form;
"Personal data / Personal Information" means data about or relating to a natural person who is directly or indirectly identifiable, having regard to any characteristic, trait, attribute or any other feature of the identity of such natural person, whether online or offline, or any combination of such features with any other information, and shall include any inference drawn from such data for the purpose of profiling; and
"Processing" in relation to personal data, means a wholly or partly automated operation or set of operations performed on digital personal data, and may include operations such as collection, recording, organisation, structuring, storage, adaptation, retrieval, use, alignment or combination, indexing, sharing, disclosure by transmission, dissemination or otherwise making available, restriction, erasure or destruction.

RELATIONSHIP AND RESPONSIBILITIES OF EXP & REAL ESTATE AGENTS

For the purpose of the Data Protection Legislation, eXp India and eXp US are a "Company" incorporated under respective state laws and may process any personal information that you provide to eXp or that eXp collects from you. This means that eXp India and eXp US are each responsible for deciding how each of them holds and uses your personal information. There may also be processing activities for which eXp India and eXp US will be jointly determining the purposes and means by which your personal information is processed by them when providing you the Services. For certain data processing activities eXp US may act as a data processor for eXp India.

It should be noted that eXp may not be the responsible party for personal information provided to its real estate agents, including on such real estate agent websites. As independent contractors, real estate agents may have their own independent business development and data collection practices. In such cases, real estate agents remain responsible for the processing of your personal information in accordance with Data Protection Legislation and their own privacy policies.

WHAT PERSONAL INFORMATION IS COLLECTED FROM YOU?

eXp will only collect personal information about you that is required to serve the purpose or purposes for which it was collected. eXp will provide specific notice at the time of collection and obtain your consent as required by applicable law. The type of personal collected will depend upon whether you are an eXp customer, a prospective customer or a Site visitor, the purpose for which the data is required and eXp's legal and regulatory obligations. eXp may collect your personal information in the capacity of a "Data Fiduciary". Your personal information may be collected in a number of ways, including when you communicate or register with eXp through the Sites or by telephone, post or e-mail. eXp India real estate agents may collect personal information as our data processors when you engage in a contract to receive the Services. As independent contractors, eXp India real estate agents may also be a data fiduciary as it relates to their own business development practices when you are not contractually engaged with eXp India and such activity is governed solely by the applicable privacy policy of the real estate agents.

Please note that eXp may process your personal information without your knowledge or consent where this is required or permitted by law.

If you are a user of the Sites, then the information that eXp collects (including when you interact with features of the Sites or request information) may include the following:

your name and contact details (i.e., address, home and mobile phone numbers, email address);
your username and password;
anything you download from the Sites;
any information that you input into the Sites.

COOKIES

eXp uses "cookies" on the Sites. A cookie is a small file of letters and numbers that is placed on your computer's hard drive when you visit certain websites. Cookies may be used, for example, to identify whether you have visited a website before or if you are a new visitor and to help identify website features in which you may have the greatest interest. Cookies may enhance your online experience by saving your preferences while you are visiting a particular site. The use of cookies on the Sites is further governed by our Cookie Policy. WHY IS YOUR PERSONAL INFORMATION COLLECTED?

eXp may process your personal information for purposes necessary for the performance of a contract with you, for example for the processing or fulfilment of the provision of its Services, and to comply with its legal obligations.

eXp may process your personal information for certain additional purposes with your consent, and in these limited circumstances where your consent is required for the processing of your personal information then eXp will obtain your separate consent at that time in a separate notice that includes the specific additional purpose and you will also have the right to withdraw your consent to processing for these specific purposes (see 'Right to Withdraw Consent' section below).

Please note that eXp may process your personal information for more than one lawful ground depending on the specific purpose for which it is using your data and for which consent has been duly obtained. All personal information collected is processed in compliance with relevant Data Protection Legislation.

Purpose and Lawful Basis for Processing

When processing your personal information, the purposes for which and the lawful bases upon which your personal information is processed include the following, to the extent that they apply to you:

to perform customer services to fulfil eXp's contractual obligations toward you, and on the basis of its legitimate interests, or your legitimate interests, to provide the best customer service we can;
to support eXp's business processes including information technology, electronic communications and electronic documents storage, management and transmissions, to fulfil its contractual obligations toward you, or, if not applicable, on the basis of its legitimate interests to provide the best customer service it can, to support its business operations, administration, IT services and network security and to prevent fraud;
to safeguard your personal information and eXp's IT system with appropriate security, on the basis of your and its legitimate interest in such security;
to exchange information, conduct due diligence and answer your initial questions, to take steps required to enter into a contract with you or for the purposes of its legitimate interests to protect its legal rights and a third party's rights or, if not applicable, on the basis of your consent;
to keep you up-to-date with news that may be of interest to you, on the basis of your consent;
to present eXp websites and online content in the best possible way for you and on your computer, on the basis of its legitimate interests to keep its websites updated and relevant, to develop our outreach and business operations, and to develop marketing strategy;
for business transactions such as a merger, acquisition by another company, or sale of all or a portion of our assets on the basis of our legitimate interests to sell or expand our business operations; and/or
to comply with legal and regulatory requirements applicable to us (including the need to prevent and combat money laundering).

Where the processing of your personal information is based on your consent only, you have the right to withdraw this consent at any time. eXp will then erase your personal information or otherwise put it beyond use and will stop processing it.

If you fail to provide certain information when requested, eXp may be unable to perform a contract entered into with you or may be prevented from complying with our legal obligations.

eXp will only use your personal information for the purposes for which it collected it, pursuant to this Privacy Policy, unless it reasonably considers it needs to use it for another reason and the reason is compatible with the original purpose. If eXp needs to use your personal information for an unrelated purpose, eXp will notify you, and will explain the legal basis which allows it to do so and shall duly obtain consent for the same.

Communications

You may receive communications from eXp if you are an eXp customer or if you have given your consent and where you have not opted out of receiving such communications. When you voluntarily send us electronic mail or fill out a form with your contact information, we will keep a record of this information so that we can respond to you. We only collect contact information from you when you register on our site or fill out a form. Also, when filling out a form on our site, you may be asked to enter your name, e-mail address or phone number. You may, however, visit our site without providing any contact information. When you submit your personal information and contact details, we reserve the right to call, SMS, email, or WhatsApp about our products and offers, even if your number has DND activated on it. You can ask eXp to stop sending you messages at any time by following the unsubscribe links on any message sent to you or by emailing privacy@expglobalindia.com at any time.

HOW LONG IS YOUR DATA HELD?

eXp will retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, legitimate administrative or operational purposes, and any reporting requirements.

The retention period is determined by the nature and duration of your relationship with eXp, local laws, contractual obligations, eXp's reasonable business requirements and your expectations and requirements. To determine the appropriate retention period for personal information, eXp will consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which your personal information is processed, whether those purposes can be achieved through other means, and the applicable legal requirements.

When it is no longer necessary to retain your personal information, eXp will securely delete or in some circumstances, anonymise your personal information (so that it can no longer be associated with you and is no longer treated as personal information).

If you request that eXp stops sending you marketing materials, it will keep a record of your contact details and appropriate information to enable it to comply with your request not to be contacted again.

SHARING YOUR PERSONAL INFORMATION

To provide its products and services and effectively run its business, eXp needs to transfer and share your personal information with its Affiliates and Independent Third Parties. Transfer and sharing of personal information may occur only as necessary to provide our Services unless we receive your explicit consent which you hereby grant by your continued usage of the website and its services.

Some of these transfers will involve international transfers of your personal information outside India including to eXp's data centers or those of its service partners or public and regulatory bodies as per applicable laws but at least a copy of such data will continue to be stored or accessible in India.

Categories of Recipients

Your personal information may be transferred to Affiliates and Independent Third Parties to perform certain business-related functions and services on our behalf. Disclosures of personal information are more fully described here under the heading 'Disclosure of Your Personal Information.'

All Affiliates and Independent Third Parties are required to take appropriate security measures to protect your personal information and are not allowed to use your personal information for their own purposes. eXp only permits them to process your personal information for specified purposes and in accordance with its instructions.

eXp reserves the right to transfer your personal information in the event of a sale or transfer of all or a portion of its business or assets.

International transfers of your personal information

The eXp Sites and the Services are operated primarily in the United States. If you are located in India, please be aware that any information you provide to us will be transferred to and stored in the United States, where the data protection laws may be different from those of India. If you are visiting the eXp Sites or requesting the Services from India, please note that we may collect, transfer, and continue to use your personal information outside of India for any of the purposes described in this Privacy Policy. When we transfer personal information across borders, the Listed Subsidiaries and our Affiliates are contractually obligated to ensure certain security measures are in place and the data use is limited to a specific purpose with regard to the cross-border transfer. By using the Services and providing us with your personal information, you consent to our collection, transfer, storage, and continued use of your personal information in accordance with this Privacy Policy. Whenever eXp transfers your personal information outside of India it will ensure a similar degree of protection is afforded to your personal information by ensuring that at least one of the following safeguards is implemented:

eXp will only transfer your personal information to countries that has equivalent, or better, data protection legislation than India; or
where eXp transfers your personal information to a third party outside of India and data protection legislation may not be equivalent to the laws of India, the third party is subject to an agreement requiring it to comply with data protection requirements equivalent or better than those applicable in India.

If eXp wishes to transfer your personal information outside of India but has not implemented one of the above safeguards then it will separately obtain your consent to that transfer. Please contact eXp if you want further information on the specific mechanisms used when transferring any of your personal information out of India.

DATA SECURITY

eXp places great importance on the security of all personal information of its customers and other data subjects. eXp has put in place appropriate security measures designed to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered, or disclosed.

In addition, access to your personal information is limited by eXp to those persons who have a business need to know. They will only process your personal information under eXp's instructions, and they are subject to a duty of confidentiality.

eXp has put in place procedures designed to deal with any suspected or actual data security breach and will notify you and the Data Protection Officer of India in the event we are legally required to do so.

YOUR RIGHTS IN RELATION TO YOUR PERSONAL INFORMATION

Depending on the facts and circumstances related to the personal information collected or obtained about you – including, for example, the nature of the information processed or where you are located or reside – you may have rights regarding the personal information held about you under relevant Data Protection Legislation. These may include the right to request information about or review or access to, the personal information held, and rights to file grievances about how your personal information is handled. The provider may also request for correction or amendment of their personal information as provided in case information is found to be inaccurate or deficient. eXp is committed to honouring your legal rights whilst ensuring that such rights are exercised in accordance with eXp's own legal and ethical obligations.

Right to withdraw consent

In the limited circumstances where you may have provided your consent to the collection, processing and transfer of your personal information for a specific purpose – for example, in relation to direct marketing you have indicated you would like to receive from eXp – you have the right to withdraw your consent for that specific processing.

Once eXp has received notification that you have withdrawn your consent, eXp will no longer process your information for the purpose or purposes you originally agreed to, unless eXp has another legitimate basis for doing so in law.

If you would like to unsubscribe from any electronic marketing communication you can also click on the 'unsubscribe' button at the bottom of the relevant communication. It may take up to 10 days for this to take place.

Right to complain

eXp strives to resolve any query or concern you raise about eXp's use of your personal information. However, if you believe that your personal information is not being lawfully processed by eXp under applicable Data Protection Legislation, you may lodge a complaint with the Data Protection Officer of India, using the contact details listed below:

Amendments to this Privacy Policy

eXp may update this Privacy Policy from time to time, and reserves the right to do so at any time to comply with applicable Data Protection Legislation. If we make material changes to the way that we collect, use or share personal information that you have provided, we will post the revised Privacy Policy on the Sites.
