For the purpose of the Data Protection Legislation, eXp India and eXp US are a "Company" incorporated under respective state laws and may process any personal information that you provide to eXp or that eXp collects from you. This means that eXp India and eXp US are each responsible for deciding how each of them holds and uses your personal information. eXp will only collect personal information about you that is required to serve the purpose or purposes for which it was collected. eXp will provide specific notice at the time of collection and obtain your consent as required by applicable law. The type of personal collected will depend upon whether you are an eXp customer, a prospective customer or a Site visitor, the purpose for which the data is required and eXp's legal and regulatory obligations. eXp may collect your personal information in the capacity of a "Data Fiduciary". Your personal information may be collected in a number of ways, including when you communicate or register with eXp through the Sites or by telephone, post or e-mail. eXp India real estate agents may collect personal information as our data processors when you engage in a contract to receive the Services. If eXp needs to use your personal information for an unrelated purpose, eXp will notify you, and will explain the legal basis which allows it to do so and shall duly obtain consent for the same.
You may receive communications from eXp if you are an eXp customer or if you have given your consent and where you have not opted out of receiving such communications. When you voluntarily send us electronic mail or fill out a form with your contact information, we will keep a record of this information so that we can respond to you. We only collect contact information from you when you register on our site or fill out a form. Also, when filling out a form on our site, you may be asked to enter your name, e-mail address or phone number. You may, however, visit our site without providing any contact information. When you submit your personal information and contact details, we reserve the right to call, SMS, email, or WhatsApp about our products and offers, even if your number has DND activated on it. eXp will retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, legitimate administrative or operational purposes, and any reporting requirements.
The retention period is determined by the nature and duration of your relationship with eXp, local laws, contractual obligations, eXp's reasonable business requirements and your expectations and requirements. To determine the appropriate retention period for personal information, eXp will consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which your personal information is processed, whether those purposes can be achieved through other means, and the applicable legal requirements.
When it is no longer necessary to retain your personal information, eXp will securely delete or in some circumstances, anonymise your personal information (so that it can no longer be associated with you and is no longer treated as personal information).
If you request that eXp stops sending you marketing materials, it will keep a record of your contact details and appropriate information to enable it to comply with your request not to be contacted again.
To provide its products and services and effectively run its business, eXp needs to transfer and share your personal information with its Affiliates and Independent Third Parties. Transfer and sharing of personal information may occur only as necessary to provide our Services unless we receive your explicit consent which you hereby grant by your continued usage of the website and its services.
